We are suffering in the United States, and worldwide, from police and 'color of law' excess or abuse of power .. because as a nation and as a world we have not held local venues - police, courts, officials, residents - responsible enough, often enough for violating our human rights. In the US we framed obedience to universal human rights when our country was formed, in our US Constitution.
What most people do not realize is that there is really only ONE law in America: our Constitution. Everything else - local courts, police authority - is an artificial delegation of authority from our Federal Government to local governments to uphold and enforce Federal, Constitutional law and Congressional mandate. That's it. That's the only 'real' job local government units have: to support our Federal Constitution and to protect us.
Somewhere along the line, this mandate became corrupted, and local venues or officials developed huge egos, and the whole point for them, became to further their own existence - as courts / judges / police deparments. The Will of the Congress, our Constitution, our nation, and our wellbeing as US citizens, was largely forgotten. Judges began demanding we call them 'RIGHT HONORABLE,' or YOUR HONOR, or ... (your HIGHNESS?) ' Such titles were part of our rebelliion against England.
We owe no one such subservience, except God.
Under our Constitution, we have only ONE LAW in AMERICA - OUR CONSTITUTION. Nothing else matters. And no local venue has the 'right' to violate our Constitution: putting a knee on someone's neck til they are deac or bullying a female firefighter until she is found hanged in the woods (Prince William and another Virginia county), violate Constitutional Rights: To liberty, freedom from search and seizure, privacy, the ability to 'live' and earn a living. To equal protection for all of us, and and to have 'equal access to justice' and 'equal protection under the law.'
We run into trouble nationwide - as with other nations that are war-torn - when we expect local 'little kids' to act like colleage graduates (federal levels). ALL OF OUR 'SERIOUS CRIMES' - murder, assault, kidnap, terrorism - fall under federal law and federal venues. Local venues are not supposed to enforce anything but local tax levies, traffic tickets, etc. But over the years, they took more and more 'assumed' power -- not explicitly listed in the Constitution -- and set themselves up as the gatekeeper for US citizens and victims... to get TO THE CONSTITUTION. THAT IS WRONG. AND IS NOW BEING EXAMINED AND CHALLENGED, following the recent police abuses and police murders.
Imagine a 'nation'of 334 million people, with rules that change every few miles - like Afghanistani warlord fiefdoms: Blonds are safe in Arlington, but not in Baltimore. Blacks are safe in this part of state X, but not that part. Asians can work here, but not there. This venue has 'safe' police - across the river they will call and leave 'shake down' demands for money or favors.
The glue that holds us together as a nation (and should also, as a world), is COMMITTMENT TO HONOR. We wrote our most important commitments down and put them into a container called the US CONSTITUTION. But now we face police and courts and other local government systems that impose themselves BETWEEN us, as US Citizens, and our Federal rights. Without supervision, local governments will always tend to abuse of power.
When we start being afraid, as innocent US citizens, of police cruisers patroling our streets or a knock on the door -- not because we've done anything wrong, but because we know how likely it is our local courts or law enforcement HAVE or WILL DO something wrong -- we have granted too much power to local levels.
WE MUST start putting offenders -- the real offenders, the judges or police or offiicials violating our US TITLE 18 Civil Rights - in PRISON, for each violation.
A House Divided
Our founder's cousins - Robert and John Kennedy - knew that a house divided against itself could not stand. Whether the division was race against race, or Federal Government against local governments. Which is what is at the heart of our nation's current unrest, police brutality and local public corruption. It will destroy us, especially in the face of challenges like Covid-19 and escalating Chinese and terrorist military threat, if this local disrespect for our nation and our Constitution is not stamped out.
